A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a erroneous removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the judge noted that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
