The NBA legend Tells Court He Felt No Fear of Nascar in Antitrust Trial

Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer emboldened his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.

Team Investment and a Will to Win

The owner disclosed operational insights of his racing venture, saying he invested $40 million of his personal wealth into the Nascar Cup series team launched with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan said during testimony. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar as a whole. From my perspective, the sport required examination from a different view.”

The Core Dispute: Charter Agreements and Renewal Demands

The heart of the case involves the end of a 2016 agreement where Nascar provided each team a franchise. The concept is similar to other professional sports with independent franchises, like the Charlotte Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.

Jordan testified for an hour and left the court to a media frenzy, with fans and media vying for a view or a picture of the global icon.

Spearheading the Fight

23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a business model Jordan contended is unlawful to maintain excessive control.

For Jordan and and Heather Gibbs, who testified before Jordan, are events from September 2024. She recounted a hectic and tense period where the sanctioning body informed teams they had to sign a contract extension. The document consists of over a hundred pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan said that 23XI and Front Row Motorsports concluded their sole viable path was to decline to sign that 112-page package and litigate the matter. The other 13 organizations agreed to the terms.

The team owners approached Nascar about potential amendments or extension options. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Winning

But in the end, the pushback against what he saw as a financially unsustainable model was mostly about the usual bottom line for Jordan: Winning.

“Denny convinced me getting a third driver improved our chances to win,” he said, sharing that he purchased another franchise last year for $28m amid the legal dispute. “So I dove in.”

Account from the Gibbs Family

Heather Gibbs detailed her request for permanent charters, submitted in a written letter to Nascar. She said the timing of the signature deadline was problematic.

She said, Joe Gibbs first tried to call and talk Nascar out of forcing signatures, but CEO Jim France declined the request.

“Don’t do this to us,” Gibbs recounted Joe Gibbs told Nascar’s leadership. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If I have 30, I have 30.”
